Look at this, did they become crazy finally?
Claiming a copyright infringement about a screenshot of an OS I legally own.
Guess this is going to be the end my friends.
Maybe someone is going to pay lawyers for claiming copyrights for odd and even numbers or maybe rectangles in due time?

MediaFire has received notification under the provisions of the Digital Millennium Copyright Act ("DMCA") that your usage of a file is allegedly infringing on the file creator's copyright protection.

The file named D1-7.6.png is identified by the key (17sha5gtosdcng3).

mediafire is trying to save its own bacon. Time to stop using this service methinks... I don't like the outlook... and I can see yet another list in the making here... "Files missing with [name of service]; list with links updated"... Sad

One trick to prolong files existence on DL servers; never set file name to it's content.

It's very easy scanning file names on a server.

It's nearly impossible scanning the content then compare to something or another of the same kind to find out if it's on list from the first example…

Looking back, it wasnt a too clever thought to make use of the cloud at all for storage. Small files are fine with amazonaws, but the big ones?
There will be tons of dead links here soon, I´m afraid.

Anyway, we might have gotten the message with the Kim Dotcom story already, didn´t we?

I was thinking of counterclaiming and this would have been my point:

This isnt copyrighted material in any way. In fact its a sreenshot of a legally owned OS, just like the extension .png indicates. Viewing the file in question would have made this discussion obsolete.

The boys in Texas can proceed at will and what I learned about lost files on MF in the past lets me think its not worth discussing the question whether a self made screenshot is rightfully owned by the person who made it.

Mediafire locked off a version of Stuffit in my archives because of a link in the comments (made by 24bit!) found here: http://macintoshgarden.org/apps/cubase-vst24-40

Apparently a "bulldog" for Steinberg found the page by googling, and sent a letter to Mediafire claiming that every link on that page was owned by Steinberg. And then it was up to me to prove that file was mine, even though it was a piece of Aladdin software that had always been available free on the web. So, when I feel like it, I'll upload it again, only slightly different, but the moral of the story is to not leave links lying all around the web pointing to these things. It's why I delete any temporary links from the Garden as soon as possible, and why I wish I didn't have to leave up the links for big files. Sooner or later...

@24bit: I think it'll make them harder to find to those looking into © especially if they´re named 'mothers_last_visit.avi' (which has to be renamed to '…sit to decompress) But as MCP says 'Sooner or later…'
Can I make it later… Wink
This subject has been up in foras with more 'extensive and intensive linking' and one rule mentioned is disguise, compress and encrypt.

@24bit, did you just loose the file or your entire account? (i lost my entire account without any warnings ;( )

And i see the mention of wired servers, if i can get hold of some more storage (have almost no cash atm) i am willing to offer space to mg. I was looking at offering some sort of mg exclusive file host, but i was struggling to find a decent free script (the one i did find wouldn't install)

If you don't file a counterclaim and ask for proof they own a screenshot generated on your computer, then you're setting them up to be able to claim anything they don't like is a DMCA violation. If you do that, then pretty soon it won't be legal anywhere in the world to post images, because you'd have to prove first that you own them.

File a counterclaim right away, and feel free to explain to MediaFire that they need to actually understand the law, and look at the files in question before sending out these notices. If they don't, it just proves they're not acting in the interests of their customers, and not doing their job.

Sad times. This is why I strive to archive as much as I can from Mac Garden on my own system. I don't trust 3rd-party hosting companies. That said, the solution is to have widespread distributed data storage of all our classic software. We are in a time when communities such as ours are desperately trying to hold onto old data that becomes more and more rare as time goes on...
