For Diablo, and Diablo II, I've seen them sold as new in retail outlets earlier this year (on the other side of the world).

Abandonware doesn't means "no longer sold" as much as it means "no longer supported." Retail sales don't affect this status because the software is sold as-is. If you buy an AppleWorks from Amazon and you run into a problem and you ask them for help, they'll simply tell you to contact Apple, which will tell you that you should had bought iWorks instead. Diablo II is still being sold at the Blizzard Store, but not Diablo. The game is over ten years old (you can read on the inside of the jewel case, "Coming in 1998: WarCraft Adventures: Lords of the Clans") and the last update for the Mac dates back to 2001, so it's safe to call it abandonware. But as you already pointed out, even if it is abandonware Blizzard still have the right to deny its free distribution. Will they do it? Well if we don't link to illegal sites like The Pirate Bay they might just leave us alone.

Everybody has a different opinion of what is abandonware. There's normally a small set of criteria that should be met, with some extra criteria added that should be satisfied automatically if the original criteria are met. I use:

Is the game / app still sold as new ?
Is the publisher still in business ?
Is it less than 10 years old ?
Does the pubisher still provide support / updates for the product ?

Different publishers support and protect their products for different periods of time, so Wolfram Research ask that the site does not share Mathematica v1, released in 1988. But EA stop providing updates for products released only 3 years ago.

I suppose that we all just don't want the site threatened by a publisher / developer because it's hosting a game / app / torrent that it shouldn't be.

Torrent links work! TPB have the best activity.
Do YOU cant download some file?
Maybe to be a few reasons:
- your ISP banned or less torrent connections (special TPB connections)
- your country (like Holland) limited or banned torrents connections (special TPB connections)
- downloaded file is not popular, and nobody seed it.
- Seeders are from another place of word, and your poor connection is broke or refused
- many other reasons

But torrent links work. TPB work. You receive file from PEOPLE, not from TPB!

I really dislike those pirate bay torrents,
either they NEVER WORK!, or are the dreaded .DMG files, I've been trying to download MYTH II and Diablo among others,
and the download % is Still 0 (zero) on ALL, (Tried on different days)
so I would like to encourage you not to post those useless torrents,
just a waste of time.

one of the things I love about Macintoshgarden is that after sooo long looking for older Mac software, finally found this site.
and I was so happy I could FINALLY was able to download those great programs directly, no 3rd party links, and now I hope it doesn't get polluted with links to a pirate useless web site.

According to the good people at the Internet, that means the tracker refused the connection, either because it was too busy or because the torrent is no longer available. The only thing you can do is keep trying.
