The code is still Ubisoft's?! That means that back in the 1980s, Brøderbund must have gotten ALL the rights, which carried over to Ubi after the untimely consolidation and breakup of Mattel Interactive.
Someone emailed this news to me. It's very exciting! Do you think a level editor will be made? Years ago, I dreamt of making custom maps... 
It's possible, and since it's not making an unofficial PoP port, it could be done with enough ability.
This also means a Mac OS X Universal copy could be made.
A win for software preservation and software openness! I have a lot of respect for Jordan Mechner, and I loved playing PoP back in the day on my Mac Plus.
