I wanted to buy it but I can only find used copies, which I don't want. I'm assuming it's abandonware but I want to confirm. So..?

I just want a new copy, I may as well not bother if they're all used. Especially if its abandonware.

OH CRAP, the following info is for the PC version -- could you use the PC files and the Mac application (extracted from an update say)?
You can still get new copies of Quake I, Jazz JackRabbit etc. Head over to Good Old Games at www.gog.com, they have downloadable copy of UT2K4, complete with wallpapers, soundtrack, addons, etc etc. All for about $5 or $10!!!
EDIT: It's $9.99, with no soundtrack 
2GB download - be advised!
PS: Once purchased, you can download the game as many times as you like! I just re-downloaded Giants:Citizen Kabuko after nearly two years... lost it in a HDD crash!
PPS: No DRM or copy protection of any kind!!
