Hmm, I'd hold off for now. I'm not sure :\
Practically speaking, uploading copies of the Mac OS is different from uploading old games. I reckon that Apple is much more likely to send a legal letter than some random game company that stopped existing in 1989.
Just a thought.
I'm pretty sure that'd be ok, people are now giving those away with second hand macs. They're also for sale everywhere on trading sites. Plus with sheep shaver and all emulating OS 9....

I suppose it depends on your definition of abandonware, unlike all the games companies, Apple still provides support downloads for all the old OS's, although this does appear to be getting more and more refined, ie. a large amount of the Knowledgebase from that era is now gone.
I stand with bertyboy. Apples stand by letting 7.5.5 out for free should mean a let go of the system versions before from their side. Let´s hope they´ll go the full mile with the rest.
That a system install disk is following a Mac, given or sold, or the disk/s themself given or sold, doesn´t say a thing about the status of that software. You can pick up Leopard from eBay or most any sales market dealing with computers in general or Macs in particular, which hardly gives that system the title of 'abandonware'. 
Let´s be a bit careful not wake a bear wich could easily wreck our shed on this new place!
